Bylaws

ARTICLE I
Name
This
association shall be known as the Pacific Barrel Horse Association (PBHA).
ARTICLE II. Non-profit
Association
This
association shall at all times be operated and conducted as a non-profit
association in accordance with the laws of the
ARTICLE III Objectives
The
Pacific Barrel Horse Association Organization has been formed for the
following purposes:
A.
To
promote the sport of Barrel Racing.
B.
To
provide a fair and equitable organization to open anyone.
C. To
publish information concerning dates and results of jackpots, association
standing and other member information.
ARTICLE
IV Boundaries of the Association
The place of business for the PBHA shall be
ARTICLE V Dissolution of the Association
In the case of dissolution of the association,
the assets of the association will be auctioned off at a time and place
determined by the executive committee. After all bills and obligations have
been settled, the remaining funds shall be donated to a local animal shelter or
hospital.
BYLAW
Chapter 1
Member
1.1 Membership
1.1.1 All membership in the PBHA shall be made by
application. Membership may be terminated or rejected by the executive
committee for cause of detrimental to the interest of the association, its
programs, policies, objective, and harmonious relationship of its members as
determined by the executive committee.
1.1.2 Any person becoming a member of the PBHA
shall become familiar with the Rules and Bylaws of the PBHA and shall comply
and be bound by same.
1.1.3 Members in good standing will receive all
the rights and privileges that are granted to them through the PBHA.
1.1.4 Annual dues for members are set at $20.00
for the first family member, an additional $10.00 for a family membership. Buckaroo
only membership is $10.
1.1.5 Membership runs from January 1 through
December 31. Membership dues must be paid before a contestant may enter an
activity.
1.1.6 An Award fee of $20.00 per horse/rider combination. All members running for year-end awards must
pay this, before their points will count for year-end awards. Buckaroo
award fee is $10.
1.1.7 An additional award fee of $20.00 may be
paid for a rider who rides more than one horse consistently.
1.1.8 Any member serving on the Board of Directors is not required to
pay a membership fee. They must pay an awards fee before their points count
towards year-end awards
1.2 Conduct of
Members
1.2.1 PBHA members shall at all times
conduct themselves in a manner so as not to reflect negatively on the
association.
1.2.2 Any misconduct or act of violence at an
association jackpot will not be tolerated.
1.2.3 Inhumane treatment of a horse at an
association jackpot will not be tolerated. The standard by which treatment will
be measured is that which a reasonable person, informed and experienced in
generally accepted equine training and competition procedures would determine
to be cruel, abusive, or inhumane. This
will include, but not limited to, excessive use of bat, crop, whip, spurs or
rope, use of an electric prod, or use of unacceptable drugs.
1.2.4 Any attempt to fix or throw a barrel race
will not be tolerated.
1.2.5 Any misconduct, including but not limited to
those items listed above, shall be brought to the attention of the Executive
Committee for consideration and appropriate action. Appropriate action may include official reprimand,
fines, loss of points, and expulsion from the PBHA.
Chapter 2
Executive committee
2.1 The Executive Committee
2.1.1 The Executive
Committee shall be comprised of 12 members.
4 of the members are grandfathered in from conception of the organization. 8
members are nominated and elected by the general membership at the year-end
meeting. Each of the 8 elected members serves a two (2) year term. The
executive committee assigns each of its member’s areas of responsibility.
2.1.2 Lifetime Members
By
a super-majority vote of the Executive Committee (10 votes), a member may be
granted Lifetime Membership. This is a very high honor and stringent selection
criteria will be applied. Lifetime
members will have their membership dues paid by the association. Lifetime
members shall be at-large members of the Executive Committee and may be called
upon in the absence of regular committee members to perform Association
business.
2.2 Duties of the Executive Committee
2.2.1 The Executive
Committee is responsible for scheduling jackpots, compiling association
standings, ordering awards, soliciting
2.2.2 Members of the
Executive Committee shall serve as judges at association jackpots.
2.2.3 Any member of
the Executive Committee may call a meeting, provided each member of the
committee is given advance notice of the proposed meeting 5 days in advance. A
meeting may be convened at any scheduled race.
2.2.4 The
Executive Committee will appoint the Grounds/ Equipment manager. The Executive
Committee may revoke the appointment at any time.
2.3 Terms
and Filling Vacancies of the Executive Committee
2.3.1 The Executive
Director appointed the 4 original members of the Executive Committee. If those
members resign then the Executive Committee will replace those members.
2.3.2 The 7 other
members of the Executive Committee serves a term of two years, where as after
the end of two years the membership will nominate and elect members for the
Executive Committee.
2.3.3 A replacement
member who is nominated and accepted by 2/3 majority of the Executive Committee
shall fill vacancies and resignations of the Executive Committee. Replacement positions will serve the
remainder of the term replaced.
Chapter 3
A
3.1
3.1.1 All activities
not covered by these articles and bylaws are not allowed unless approved by the
Executive Committee.
3.1.2 All challenges
and disputes under the association’s articles and bylaws or with decisions made
by jackpot judges shall be submitted to the Executive Committee in writing with
a $25.00 fee, to be returned if the executive committee rules in favor of the
dispute or challenge. The decision of the Executive Committee will determine
all discrepancies and will be final.
3.2 Amending the Association Articles and
Bylaws
3.2.1 The Executive
Committee may revise the association’s rules. The committee is responsible for
providing each member with a current rulebook and amendments when it is
revised.
3.2.2 A
quorum of 5 members of the Executive Committee is required to conduct
association business or to hold association meetings.
Chapter 4
Jackpot
4.1 Jackpots
4.1.1 A minimum of twelve (12) Jackpots will be scheduled
annually. Other shows may be scheduled as fundraisers.
4.1.2 Members
must attend at least 6 jackpots in order to qualify for year-end awards.
4.1.3 Jackpots
are open to all members.
4.1.4 Time runs, Exhibitions, Open, Youth,
4.2 Time
Runs/Exhibitions
4.2.1 A $3.00 timer fee will be charged for all time runs. (A
run is considered once through the course) Time runs
are sold at the gate, the cut-off time will be posted.
4.2.1a Exhibition
runs may be offered at the conclusion of the Open class. The fee is $5.00.
Exhibition riders must be entered by the start of the Open class. A draw for
this class will be posted. Entries will be limited for this class.
4.2.2 A
4.3 Youth Barrels
4.3.1 The
entry fee for the youth class shall be $7.00.
4.3.2 The Youth
class is open to all persons eighteen (18) years and younger. Age determined on
1st day of competition.
4.3.3 The Youth
class will be run in a 5D format. The time splits will be the same as the open
class
4.3.4 Points will be
awarded to 5 (five) places in each of the 5 divisions.
4.4 Open Barrels
4.4.1 The
entry fee for the Open class will be $15.00.
4.4.2 The Open Class is open to all riders
regardless of age.
4.4.3 The Open Class will consist of five (5) divisions for
jackpot payout. The 1D will set the fastest time of the barrel race with 2D
being 0.5 seconds slower, 3D division being 1 second, and 4D being 1.5 seconds
off the fastest time respectively. The 5D division will be 2 seconds off the
fastest time.
4.4.4 Points will be awarded up to ten (10) places in each
of the 5 divisions when applicable.
4.4.5
4.5
4.5.1 The
entry fee for the senior class shall be $7.00.
4.5.2 The senior
class is open to all persons forty-five (45) years and older as of Their Birth date.
(A rider may start riding senior on their 45th Birthday or after)
4.5.3 The senior
class will be run in a 4D format. The
splits shall be 0.5 seconds. The fastest rider shall set the pace with the 2D ½
second slower and the 3D 1 second slower and the 4D 1.5 seconds slower than the
fastest rider.
4.5.4 Points will be
awarded to 5 (5) places in each of the 4 divisions.
4.5.5
Medals
Class
The
PBHA medals class is open to PBHA members only, horses must have NEVER
ran in the 1D or 2D in ANY 4D or 5D open race prior to 1st
day of the season. The Class will have a $10 entry fee and will be 4 divisions,
½ second between divisions. 70% payback. Medals riders
must run in the class, times cannot be rolled into the Medals class.

four divisions will be Platinum, Gold,
After nomination to the class, any
horse that rides a time in Medals Class at a PBHA Prime show during the current
season that would have put them in the PBHA 1D or 2D open class on that day
will “graduate” from Medals class and will no longer be eligible to compete in
the Medals Class.
Exceptions to the nomination
requirements will be considered on a case-by-case basis by the Directors.
(An
example of this would be an aged horse that no longer competes at a high level)
4.6 General Racing Rules
4.6.1 Where these bylaws are not specific,
generally accepted barrel racing practices will govern as approved by the
Executive Committee.
4.6.2 Knocking
down a barrel will result in a no time.
4.6.3 A no- time
will be given if the contestant breaks the clover-leaf pattern, by crossing
over the start-finish line or circling barrels more than once or if contestant
stops their run due to equipment failure.
(Backing up does not necessarily constitute a break in the pattern).
4.6.4 Contestants
must attempt to make the fastest run possible. Any obvious attempt to “pull up”
or pace their run will result in reprimand up to and possibly a
disqualification.
4.6.5 An
electric timer shall be used whenever possible.
4.6.6 In
the event of a timer failure:
A) If a barrel or pole is knocked down prior to
timer failure it will be considered a no time, no options will be offered.
B) If no barrels or poles are knocked down prior
to the announcement of the timer failure the contestant will be given the following
options:
1.) Draw out and have their entry fee refunded.
2.) Take a re-run either at the end of their
rake or at the end of the class after a rake.
4.6.7 The standard pattern for the setting of barrels is:
4.6.8
The pattern shall be adjusted to the size of the arena proportionately to the
standard pattern above. The minimum distances from the fence/wall listed in 4.6.7
shall be maintained. Barrels may be set more than 15 feet off the wall.
4.6.9 The
barrels will be marked with either tags or chalk.
4.6.10 During warm up
before a jackpot, contestants caught circling the barrels or chalk shall be
asked to leave the arena and may be disqualified.
4.7 Buckaroo Class
4.7.1 Buckaroo
class is open to those children under the age of ten (10). Buckaroo will include lead lines.
4.7.2 No
cross entry between Buckaroo or any other class.
4.7.3 Buckaroo
is a non-competitive class all awards are standard.
4.8 PBHA General Dog Rules
4.8.1 No loose dogs allowed on the
grounds or near the arena during the race day. No dogs allowed in the arena
except on a leash during a rake. Owners are responsible for cleaning up after
their dogs. Dogs that bark or display aggression shall be removed from the
arena area. In addition, aggressive dogs
may be asked to be removed from the premises.
Chapter 5
Pole
5.1 Poles
5.1.1 Poles consist
of white 1 inch PVC pipe attached to a rubber base. The course consists of 6 poles spaced
twenty-one (21) feet apart in a straight line. 1st pole is 21 feet
from the starting line. Last pole shall
be a minimum of 25 feet from the back wall.
Whenever possible the poles will be set down the middle of the arena. When this
is not possible the poles shall be set a minimum of twenty (25) feet from a sidewall.
5.1.2 The pole
bending pattern will be run by crossing the start line and proceeding to the
sixth (6) pole in line. Turning the sixth (6) pole and weaving back down the
line, turning the first (1) pole in line and weaving back to the sixth (6) pole
tuning the sixth (6) pole and proceeding to the finish line. The rider will
finish on the opposite side of the pole course that they started on.
5.1.3 Knocking
over a pole shall constitute a no time.
5.1.4 Not
following the pattern will constitute in a no time.
5.1.5 Breaking the
timer before the run is finished shall be a no time.
5.1.6 Poles will
consist of four (4) divisions. The 1st division will be set by the
fastest time of the class with the 2nd 3rd and 4th
divisions being 1 second, 2 seconds and 3 seconds off the fastest time,
respectively.
5.1.7 Points towards year-end awards will be
awarded up to ten (10) places in each division based on the number of riders.
5.3 Other Events
5.3.1 Other events
can be run at the show. This will allow coordination and sanctioning with other
organizations. Events that are not under
5.1-5.2 shall follow established rules
and courses of other organizations. If rules or courses are not readily
available, the executive committee shall work up and publicize the rules and
courses of the event before it is run.
Chapter 6
Payoff
6.1 Places to be Paid
6.1.1 The number of
places to be paid out is listed in the tables below.

6.1.2 In
the event that the number of places to be paid in a division is greater than
the number of contestants that fell into that division. The number of places
paid to that division shall be adjusted to equal the number of contestants that
fell into that division.
6.1.3 In
the event that no contestants fall into a particular division, the monies from
that division will be split proportionally into the remaining divisions.
6.2 Divisions
of Monies
6.2.1 Monies for 4D classes will be split between
the divisions of the 4D with 30% going
to the 1D, 27% to the 2D, 23% to the 3D and 20 % going to the 4D of the total
jackpot and any added money.
6.2.1a Monies for 5D classes will be split between
the divisions of the 5D with 26% going
to the 1D, 23% to the 2D, 20% to the 3D, 17 % going to the 4D, and 14% going to
the 5D of the total jackpot and any added money.
6.2.2 Monies
in each division will be divided as follows:

6.2.3 The payoff for each place shall be figured by
multiplying the number of entries times the entry fee (award and finals fees),
times 0.8, adding any added money, and multiplying this total by the percentage
for the division times the percentage for the places

6.2.4 Honoring
Payout Checks - PBHA will honor a check up to 1 year after original issuance.
Accounts need to be balanced at least yearly. All checks not cashed within a
year will be considered a donation to they association.
Chapter 7
Point
7.1 Earning Points
7.1.1 Points will be
awarded to members in the 5 open divisions of Open Barrels and the 4 divisions of
Open poles with ten (10) points to the highest placing member, nine (9) points
to the second highest placing member, eight (8) points to the third highest
placing member etc. of each division.
7.1.2 Points will be
awarded to members in Youth and
7.1.3 If a member’s
nominated horse is unable to continue during the season, a member may do a one
time transfer of points to another un-nominated horse. The horse that was
unable to continue will not be eligible to enter PBHA prime races for the
duration of the season. Exception: If
the horse is sold to another member it may be nominated and entered at future
races.
7.2
7.2.1 Points earned
by a horse/rider combination in each division will be kept separate throughout
the season.
7.2.2 Members
must attend at least six (6) shows and accumulate six (6)-work points to
qualify for year-end awards.
7.2.3 The
number of year-end awards shall be determined by adding the number of members
that have points in each division. Dividing this number by two (2) and dividing
that number by three (3). This equals ½
the average of the members will receive awards.
The Executive Committee may adjust the number of awards if there is an
excess amount of sponsorships or not enough monies to provide for awards.
Example 1D 12 members
have points, 2D 15 members have points, 3D 14 members have points and 4D
14members have points.
Calculation: 12+ 15 + 14+14 =55 / 2 =
27.5/ = 6.8 or 7 places in each division.
A
7.2.4 The
Executive Committee will determine the dollar amount of the year end points.
This may be adjusted for each class according to entry fees.
Chapter 8
Work point
8.1 Members work points
8.1.1 All members
wishing to qualify for year-end awards shall accumulate 6 work points before
the year ends.
8.1.2 Work points
are accumulated by working at the shows, setting barrels, raking, running the
tractor, setting up and taking down the courses, show secretary, timer,
cleanup, gate person, etc.
8.1.3 1 work point
will be given when a member works a full show.
8.1.4 It is the member’s responsibility to see
that their name appears on the work sheet when they have worked at a show.
8.1.5 The executive
committee will be in charge of keeping the work points.
8.1.6 If a member
has a friend or family member that works at the show, that member may claim the
work points for themselves. Only one member can claim the work points of a
friend or family member at each show.
Chapter
9
9.1
9.1.1 The
PBHA season races are PBHA prime and will be run under PBHA format and rules.
9.1.2 PBHA
may produce other events run under other organization rules throughout the
year.
9.1.3 The Executive Committee shall approve sanctioning with
other organizations.
9.1.4 Members
may petition the Executive Committee at any time during the year for
co-sanctioning approval or proposing a PBHA produced event.
9.1.5
Chapter 10
Arena
10.1 Arenas
10.1.1 The executive
committee in concurrence with the Grounds/ Equipment manager will have the
final approval of all arenas. An arena that has been deemed unsafe or not
useable because of limited parking, bad ground or other reasons will not be
considered for jackpots.
10.1.2 The Grounds/
Equipment manager shall prepare the arena for the jackpots. The ground manager
may delegate this responsibility to anyone he/she deems qualified.
10.1.3 The Grounds/
Equipment manager will set the raking sequence at each Jackpot. If members
suspect an unsafe condition they are encouraged to notify the Grounds manager
or other directors.
10.2 Arena fees
10.2.1 Arena fees
shall be charged to each horse. Cost will depend on the cost of the arena plus
$2.00 for insurance per rider and the anticipated number of horses entered.
Typically it will run $5.00 + $2.00 =
$7.00
Chapter
11
In
11.1 Insurance
11.1.1 PBHA
11.1.2 Members are
advised to carry their own insurance in case of injury to their animals or
their animals injuring someone else or damaging property.
Chapter 12
Relea
12.1 Release of Liability
12.1.1 All
members upon joining the Pacific Barrel Horse Association (PBHA) hereby agree
to comply with all rules and regulations of the arena owners, the executive
committee as stated in this book and PBHA
12.1.2 Members
agree to waive and release all claims against the Pacific Barrel Horse
Association, its Directors, members, volunteers, sponsors and facility owners
including any and all claims for damage caused by negligence of any of them,
arising out of participation in PBHA events and related activities.
12.1.3 Members
further agree to indemnify, release, hold harmless and defend the Pacific
Barrel Horse Association, its Directors, volunteers, sponsors and arena owners
against any and all claims of injury or damage to persons, animals or property.
12.1.4 Members
understand that horses and activities involving horses can cause serious injury
or death. Members hereby acknowledge that participation in PBHA activities
12.1.5 Members
under the age of 18 must have a signed waiver from his/her parent or legal guardian
before they may participate in any PBHA activity.
12.1.6 All
members are strongly encouraged to wear an approved safety helmet, especially
those under the age of 18.
12.1.7 Everyone
must sign a waiver/release of liability when applying for membership and at all
activities when required.
